SCOPE OF APPLICATION

This webstore is operated by CF Services GmbH. These terms and the conditions are applied to the products purchased via the www.store.cardano.org website. Throughout the site, the terms “we”, “us” and “our” refer to the Cardano Store and by “you” we refer to the customer or user of the store.  

Please read these Terms of Service carefully before accessing or ordering anything. By accessing or using any part of the site, you agree to these terms and conditions. If you do not agree to all the terms and conditions mentioned, then you may not access the website or order anything. 

You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these Terms by posting updates and/or changes to our webstore. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

By placing an order through the website, you warrant that you are at least 18 years old and are legally capable of entering into binding contracts. You may not use our products for any illegal or unauthorised purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws). 

SECTION 1 - CONTRACT

The purchase contract with Cardano Store is concluded as soon as the order is placed. When ordering via Cardano store, an order confirmation is automatically generated by the system and sent to the customer’s previously provided email address. That message only confirms the order, but does not guarantee any availability. A minimum order amount may be required for purchases. Orders below the set threshold will not be processed.

The information set out in the Terms and the detail contained on this website do not constitute an offer for sale but rather an invitation to treat. All orders are subject to acceptance by us. We will confirm such acceptance and a contract will only be formed when we send you an email that confirms the product has been dispatched (the “Shipping Confirmation” email).

Cardano Store may cancel the order if products are not available or out of stock for any other reason, which prevents Cardano Store from delivering the order to you. In this case, we are not liable to you for any damages or delays. If the delivery is impossible or the prices are incorrect, we will inform you as soon as possible. If no agreement can be reached, we will reimburse the amount paid by you. 


SECTION 2 - PRODUCTS 

2.1 We reserve the right, but are not obligated, to limit the sales of our products or services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the email and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgement, appear to be placed by dealers, resellers or distributors.

2.2 We reserve the right to limit the quantities of any products or Services that we offer. We reserve the right to discontinue any product at any time. We do not warrant that the quality of any products, services, information or other material purchased or obtained by you will meet your expectations.

2.3 Certain items within our store may be designated as "Proof of Concept Products" (POC Products). By purchasing POC Products, you acknowledge and understand that:

  • POC Products or parts thereof may not function as intended.
  • The performance of POC Products may vary, or they may not work at all.
  • POC Products are sold "as is," and no warranties, either expressed or implied, are provided for these items.
  • The Cardano Foundation (referred to as "we" or "us") accepts no liability for any issues or limitations related to the functionality of POC Products.



SECTION 3 - DELIVERY

After the order has been received, the products are sent to the delivery address specified by the customer. The customer is responsible to provide correct shipping details. Usual delivery times are 2-8 working days for addresses in the EU/EEA/EFTA/ area. Delivery times abroad depend on the country and depending on particular logistic times. We send all orders with tracking numbers, so that you can see where the delivery is at all times or check the order status.

By engaging in a pre-sale transaction with the Cardano Store, you acknowledge and agree that the delivery of the purchased products is contingent upon the capacity and availability of our suppliers. The Cardano Store relies on third-party suppliers for the procurement and production of the products offered during the pre-sale period. The delivery timeline for pre-sale period is subject to the capacity, production schedules, and any unforeseen circumstances that may affect the ability to fulfil the order. Any estimated delivery dates provided during the pre-sale period are indicative and based on information available at the time of the transaction. The Cardano Store shall not be held responsible for delays caused by supplier constraints or other factors beyond our control.

Please remember that we may not deliver on Saturdays, Sundays or your local public holidays. For the purpose of these terms, the "delivery" shall be deemed to have taken place, or the order considered as having been delivered at the time that receipt of the order has taken place at the agreed delivery address.

With regards to any virtual gift card(s), we will send it on the date indicated by you when you place your order. If for any reason we are unable to deliver on this date we will duly inform you and give you the option to continue with the purchase with a new delivery date or alternatively, cancelling the order and reimbursing you with the full amount paid.

 

SECTION 4 - INTERNATIONAL DELIVERY

We ship worldwide, however a few exceptions apply. Currently we are not able to offer delivery to the following countries: Afghanistan, Belarus, Bhutan, Brunei, Central African Republic, Chad, China, Cuba, Democratic Republic of the Congo, Ecuador, Egypt, Equatorial Guinea, Guinea-Bissau, Iran, Iraq, Kosovo, Laos, Liberia, Libya, Mongolia, Morocco, Myanmar, Nepal, North Korea, Pakistan, Russia, Samoa, Sierra Leone, Somalia, South Sudan, Sudan, Syria, Timor-Leste, Turkmenistan, Ukraine, United Kingdom, Venezuela, Yemen, and Zimbabwe.  

International delivery times to addresses outside the EU/EEA/EFTA area depend on the country and depending on particular logistic times.

You will be responsible for complying with all laws and regulations of the country to which you import the products. If you order products from our store for international delivery, your order may be subject to customs inspections, import duties and taxes which are applied when the delivery reaches that destination. Please note that we have no control over these charges and we cannot predict their amount and we are not liable for delayed delivery times due to shipments being inspected by customs’ authorities.

 

SECTION 5 - RISK AND TITLE

The products will be at your risk from the time of delivery. Ownership of the products will only pass to you when we receive full payment of all sums due in respect of the products, including delivery charges, or upon delivery (as defined in section 3 above), whichever occurs last.

 

SECTION 6 - PRICES AND AVAILABILITY

We have made every effort to display the colours and images of our products available as accurately as possible. However, we cannot guarantee that your computer monitor's display of any colour will be accurate.

Product prices do not include shipping costs. Shipping costs per order are displayed at checkout, when the customer chooses the delivery method. We reserve the right to change prices and shipping costs in a way that such changes are only applied to orders made after the changes become effective. 

Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue products available without notice. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of products.

We aim to show availability and delivery times as accurately as possible. However, there may be availability or delivery delays for various reasons in high seasons or due to technical or human nature, which is why all information on availability and delivery times is without guarantee. We aim to provide correct and updated information on the products and their availability on CardanoStore, but cannot guarantee the accuracy of the data, the availability or sufficient number of products. Only a limited number of products are produced, or a product may also be temporarily sold out. 

Please note that Cardano Store does not have a holding shopping cart. 



SECTION 7 - VALUE ADDED TAX AND PAYMENT METHODS

Customers are responsible for possible import taxes and VAT outside of the EU area. If you order in the EU area, we will charge you the local VAT and there will be no extra charges for VAT. Possible VAT costs will appear in the checkout. 

Payment service providers are third-parties with whom we have entered into a contract. The customer enters payment information and details on the bank or payment provider’s site.

You acknowledge and agree that all copyright, trademarks and all other intellectual property rights in all material or content supplied as part of the website shall remain at all times vested in us. You are permitted to use this material only as expressly authorised by us or our licensors.

Certain content or products available via our store may include materials from third-parties. Third-party links on this site may direct you to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third-party materials or websites, or for any other materials or products of third-parties. We are not liable for any harm or damages related to the purchase or use of goods, services, resources, content, or any other transactions made in connection with any third-party websites. Please review carefully the third-party's policies and practices and make sure you understand them before you engage in any transaction. Complaints, claims, concerns, or questions regarding third-party products should be directed to the third-party.

SECTION 12 - ERRORS AND INACCURACIES

Occasionally there may be information on our store or products that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).



SECTION 13 - EVENTS OUTSIDE OUR CONTROL

We will not be liable or responsible for any failure to perform, or delay in performance of any of our obligations that is caused by events outside our reasonable control (“Force Majeure Event”). 

A Force Majeure Event shall include any act, event, non-happening, omission or accident beyond our reasonable control and shall include in particular (without limitation) the following: 

  • Strikes, lock-outs or other industrial action. 
  • Civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war. 
  • Fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster.
  • Impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport. 
  • Impossibility of the use of public or private telecommunications networks. 
  • The acts, decrees, legislation, regulations or restrictions of any government. 
  • Any shipping, postal or other relevant transport strike, failure or accidents. 

Our performance is deemed to be suspended for the period that the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period. We will use our reasonable endeavours to bring the Force Majeure Event to a close or to find a solution by which our obligations may be performed despite the Force Majeure Event.



SECTION 14 - GOVERNING LAW

These Terms and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Germany.

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website.
